These Terms and Conditions ("Terms") govern your use of the website swastikconsultants.org and the consulting services provided by Swastik Consultants ("Company", "we", "us", or "our"), located at 1460, HBC, Sector-14, Near Gandhi Chowk, Sonipat – 131001, Haryana, India. By accessing our website or engaging our services, you agree to be bound by these Terms.

1. Services

Swastik Consultants provides MSME subsidy consulting services including but not limited to:

• MSME/Udyam Registration assistance
• ZED (Zero Defect Zero Effect) Registration and Certification
• R&D Registration and Certification
• ISO Certification and Implementation
• Government Scheme Identification and Application Assistance

Our services are advisory in nature. While we prepare and file applications on your behalf, the final approval of any subsidy or scheme is at the sole discretion of the relevant government authority. We do not guarantee approval of any application.

2. Client Responsibilities

As a client of Swastik Consultants, you agree to:

• Provide accurate, complete, and up-to-date information and documents
• Inform us promptly of any changes to your business information
• Cooperate fully with our team during the application process
• Pay agreed service fees as per the agreed payment schedule
• Not hold us liable for delays caused by government departments or portal issues
• Ensure all information provided to us is truthful and legally compliant

3. Fees and Payment

Our service fees are agreed upon at the time of engagement and outlined in the service agreement. Fees are non-refundable once work has commenced unless otherwise specified in writing. Payment schedules are as agreed in the individual service agreement.

We reserve the right to suspend services in case of non-payment. Any additional work beyond the agreed scope will be charged separately after prior written consent from the client.

4. No Guarantee of Results

While we strive to achieve the best possible outcome for every client, Swastik Consultants does not guarantee:

• Approval of any subsidy application by the government
• Specific timelines for government processing or disbursement
• A specific subsidy amount unless confirmed in writing by the government
• Continued availability of any government scheme

Government schemes, eligibility criteria, and subsidy amounts are subject to change without notice. We will keep you informed of any material changes that affect your applications.

5. Confidentiality

Both parties agree to maintain strict confidentiality of all business information, financial data, and documents shared during the engagement. Swastik Consultants will not disclose your confidential information to any third party except as required for government applications or by law. This obligation continues after the termination of the service agreement.

6. Intellectual Property

All content on the Swastik Consultants website including text, graphics, logos, and images is the property of Swastik Consultants and is protected under applicable intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Swastik Consultants shall not be liable for:

• Indirect, incidental, or consequential damages arising from our services
• Delays or decisions made by government authorities
• Loss of business opportunity due to scheme changes or rejections
• Any damages arising from reliance on information provided on our website

Our total liability in any case shall not exceed the fees paid by you for the specific service in question.

8. Termination

Either party may terminate the service agreement with 15 days written notice. Upon termination, all outstanding fees become immediately payable. We will provide you with all documents and files related to your applications. Ongoing applications will be handled as per mutual agreement.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Sonipat, Haryana.

10. Dispute Resolution

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator mutually agreed upon by both parties.

11. Website Use

You agree to use our website only for lawful purposes. You must not use our website in any way that violates applicable local, national, or international laws or regulations. We reserve the right to restrict access to our website at any time without notice.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
